Petición de la Organización de Mujeres Árabes en apoyo a las mujeres de Jordania

Nosotras, en representación de las mujeres en Jordania, queremos compartir con usted las recientes medidas para garantizar la igualdad de género y  poner fin a todas las formas de discriminación contra la mujer. Después de la primavera árabe, ha habido un acuerdo tácito de que la Constitución de Jordania debería ser revisada ​​y modificada si fuera necesario para traer más cambios democráticos en el país.

Esto abrió una oportunidad para las mujeres para abogar por la adición de la palabra "género" en el artículo 6 de la Constitución como un paso fundamental y necesario que garantice la igualdad de género. El artículo 6 estipula que: "no habrá discriminación entre los jordanos en lo que respecta a sus derechos y obligaciones por motivos de raza, idioma o religión". Incluyendo la palabra "género",  se establece el hecho de que la Constitución de Jordania  prohibe cualquier  tipo de discriminación contra la mujer y que todas las partes interesadas deben garantizar la justicia y la igualdad para las mujeres jordanas.

Muchos países, entre ellos 20 países árabes, como Marruecos, Túnez, Qatar, Omán, así como muchos países musulmanes, como Bangladesh, Irán, Malasia e Indonesia han estipulado claramente que el principio de no discriminación también se incluya  motivos de "género" .

En la mitad del proceso de la inclusión de la palabra "género" en el artículo 6, nos sentimos decepcionados porque la Comisión Real sobre la Revisión Constitucional no cumplió su promesa. En este momento, las mujeres activistas están haciendo negociaciones con  al Parlamento (diputados y senadores) para revisar las enmiendas al proyecto  y encontrar una manera de incluir "género" o una declaración clara sobre la igualdad entre hombres y mujeres.

Creemos que esta es una oportunidad preciosa para que el Estado cumpla sus obligaciones contraídas en especial por la ratificación de la Convención sobre la Eliminación de Todas las Formas de Discriminación contra la Mujer (CEDAW). Las observaciones finales aprobadas por el Comité de la CEDAW tras la revisión del informe  3º y 4º sobre el estado de Jordania en la 39 ª reunión establece claramente la obligación del Estado y  le alienta  a instituir una reforma constitucional para incorporar la igualdad en  base al sexo en el artículo 6 de la Constitución, y a llevar a cabo una revisión de toda la legislación existente para lograr la plena concordancia con la Convención (párrafo 171).

Incluyendo la palabra de "género"  en las enmiendas a la Constitución se asegurará de que todas las leyes y políticas no sean discriminatorias sobre la base del género en cualquier situación o contexto. Esto también creará la oportunidad para una interpretación más amplia que incluya los principios de la igualdad sustantiva en todas las leyes y políticas  que tendrán que ser compatibles con la Convención. Nuestro gobierno tiene que entender sus obligaciones en virtud de dichos acuerdos  y debe asumir la responsabilidad para avanzar en la realización de los derechos humanos de las mujeres.

Nosotros, los abajo firmantes, pedimos al Gobierno Jordano que cumpla todas sus obligaciones contraídas, tanto a nivel nacional como internacional para la protección y promoción de los derechos humanos de las mujeres.

Somos de la opinión de que la inclusión de "género" en el artículo 6 de la Constitución es el primer paso para asegurar que los principios de no discriminación e igualdad  esencial  serán consagrados en la Constitución del país.

We, representing women in Jordan, would like to share with you the recent steps to ensure gender equality and further end all forms of discrimination against women. After the Arab Spring, there had been a tacit agreement that the Jordanian Constitution shall be reviewed and if necessary amended to bring forth more democratic changes to the country.

This opened an opportunity for women to lobby for adding the word "gender" to Article 6 of the Constitution as a fundamental and necessary step that would ensure gender equality. Article 6 stipulates that: "there shall be no discrimination between Jordanians as regards to their rights and duties on grounds of race, language or religion". Including the word “gender" establishes the fact that the Jordanian Constitution will prohibit any and all forms of discrimination against women and that all parties concerned must ensure justice and equality for Jordanian women.

Many countries, including 20 Arab countries, like Morocco, Tunisia, Qatar, Oman, as well as many Moslem countries, like Bangladesh, Iran, Malaysia and Indonesia have clearly stipulated that the principle of non-discrimination also includes the grounds of "gender".

Mid way through the process of the inclusion of word "gender" to Article 6, we were disappointed because the Royal Committee on Constitutional Review did not keep its promise. . Right now, women activists have moved to lobby the Parliament (Deputies and Senators) to revisit the draft amendments and find a way to include "gender" or provide a clear statement on equality between men and women.

We feel that this is a precious opportunity for the State to honour its obligations made especially by its ratification of the Convention on the Elimination of all Forms of Discrimination against Women (CEDAW). The Concluding Observations adopted by the CEDAW Committee after the review of 3^rd and 4^th state report of Jordan at the 39^th session clearly stipulates the obligation of the State and encourages the State to institute a constitutional amendment to incorporate equality on the basis of sex in article 6 of the Constitution, and to undertake a review of all existing legislation to bring it fully into compliance with the Convention (para 171).

Including the word ‘gender’ in the amendments to the Constitution will ensure that all laws and policies are non-discriminatory on the basis of gender in any situation or context. This will also create the opportunity for a broader interpretation that would include the principles of substantive equality as all laws and policies will need to be CEDAW compliant. Our government has to understand its obligations under treaty law and be held accountable towards advancing the realisation of women’s human rights.

We, the undersigned, call on the Jordanian government to honour all its obligations made both at the domestic and international levels for the protection and promotion of women’s human rights.

We are of the opinion that the inclusion of  ‘gender’ to Article 6 of the Constitution is the first step towards ensuring that the principles of non-discrimination and substantive equality  will be upheld by the Constitution of the country.
